General terms and conditions of business

1) Scope

The following terms and conditions apply to all orders placed through this shop. This offer is intended for private consumers only.

A consumer is a natural person who concludes a legal transaction for purposes that cannot be primarily attributed to his or her commercial or independent professional activity.

2) Contracting parties and conclusion of contract

A purchase contract is concluded with the contractual partner MAYAN upon placing the order and receiving payment. If payment is not received within 5 business days, the contract will be canceled.

3) Contract language and contract text storage

The language for the conclusion of the contract is German. The privacy policy and cancellation policy can be found under the respective headings.

4) Delivery conditions & returns

In addition to the stated product prices, shipping costs of €3.99 (Germany) or €5.99 (EU) apply. Shipping is via DHL with a tracking ID.
A return fee of €5.95 applies for German customers and €9.95 for EU and Swiss customers. These fees will be deducted from the refund.
In the event of a return, the original shipping costs will not be refunded.
When returning a gift set, the €5.00 gift wrapping fee will not be refunded. If the order was originally free of shipping costs and is returned, a flat rate of €3.99 (Germany) or €5.99 (EU + Switzerland) will be charged for the refund.

For a partial return that falls below the free shipping limit, we will charge the original shipping fee of €3.99. Likewise, the discount will not apply to partial returns if the discount was tied to the purchase of a specific number of items.

5) Payment

The following payment options are available to the customer:

- Klarna purchase on account
- Klarna Sofort
- PayPal
- Credit card (Visa, Mastercard, Amex)
- Google Pay
- Apple Pay

6) Retention of title

The goods remain the property of MAYAN until full payment has been made.

7) Transport damage

Should any damage occur during transport, the customer must immediately report this to the delivery agent and notify the seller. Failure by the customer to do so will have no effect on their statutory or contractual claims for defects.

8) Warranty, guarantee and customized goods

The statutory right of return for clothing applies if there is a defect and unless expressly agreed otherwise. If a defect is discovered in the item of clothing, the buyer has 30 days from receipt of the goods to exercise their right of withdrawal.
Please note that only unworn, unwashed and originally labeled items can be returned.
The costs for a return are always borne by the buyer.
Any shipping costs incurred will not be refunded.

9) Alternative dispute resolution

The EU Commission provides a platform for online dispute resolution on the Internet at the following link: https://ec.europa.eu/consumers/odr

This platform serves as a contact point for the out-of-court settlement of disputes arising from online sales or service contracts involving a consumer.

The seller is not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
