General Terms and Conditions
§ 1) Scope
The following terms and conditions apply to all orders placed through this shop. This offer is directed exclusively at private consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
§ 2) Contracting parties and conclusion of contract
A purchase contract is concluded once an order is placed and payment has been received by the contracting party, MAYAN. If payment is not received within 5 business days, the contract will be cancelled.
§ 3) Contract language and storage of the contract text
The language for concluding the contract is German. The privacy policy and the withdrawal instructions can be found under the respective sections.
§ 4) Delivery terms & returns
In addition to the stated product prices, shipping costs of €4.99 (Germany) or €7.99 (EU and Switzerland) apply. Shipments are sent with a tracking ID via DHL.
In the case of a return, the customer bears the return shipping costs. Customers from Germany can request a return label for €5.99 upon request. These fees will be deducted from the refund. Return shipments from EU countries, Switzerland or the United Kingdom must be covered by the customer themselves. Any customs fees incurred will not be reimbursed.
In the case of a return, the shipping costs originally incurred will not be refunded.
For the return of a gift set, the €5.00 gift-wrapping fee incurred will not be refunded.
If a return is generally not packaged in its original condition, a packaging and restocking fee of €5.00 will be charged.
If the order was originally shipped free of charge and is returned, a flat fee of €4.99 (Germany) or €7.99 (EU + Switzerland) will subsequently be deducted from the refund.
Return shipments from Switzerland must be covered by the customer themselves.
For a partial return that causes the order value to fall below the threshold for free shipping, we will charge the original shipping costs of €4.99. Likewise, any discount tied to the purchase of a certain number of items will no longer apply in the case of a partial return.
The customer has the right to return the goods within 30 days of receipt. The return must be registered in advance, either by email or via the return process we provide. If goods are returned without prior registration, or after the 30-day return period has expired, there is no entitlement to a refund of the purchase price.
After withdrawing from the contract, the customer must return the goods within 14 days (Section 357(1) BGB); if this deadline is exceeded, MAYAN is under no obligation to accept the goods or issue a refund.
In the event of a full or partial withdrawal from the purchase contract, the customer is obliged to return any free gifts received as part of the order as well. If free gifts are not returned, we reserve the right to deduct the corresponding value of the goods or invoice it separately.
In the event of a package hold requested by the customer, a processing fee of €5.99 (Germany) or €7.99 (EU) will be charged. This amount will be deducted from the total amount originally paid.
§ 5) Undeliverable shipments / returns due to failure to collect or incorrect address details
If a shipment cannot be delivered for reasons attributable to the customer and is returned to us (e.g. due to failure to collect from the post office/parcel station, refusal to accept delivery, or incorrect or incomplete name or address details), we reserve the right to cancel the purchase contract.
In this case, the customer will be invoiced for the shipping costs incurred as well as the return shipping costs, or these will be deducted from the purchase price to be refunded. The goods will only be resent once the customer has covered the shipping costs in advance.
Further statutory rights remain unaffected.
§ 6) Payment
The customer has the following payment options available:
- Klarna purchase on account
- Klarna instant transfer
- PayPal
- Credit card (Visa, Mastercard, Amex)
- Google Pay
- Apple Pay
§ 7) Retention of title
The goods remain the property of MAYAN until paid for in full.
§ 8) Compensation for value in the case of returns
The customer is entitled to inspect the goods to the same extent as would be possible and customary in a physical shop.
However, if the goods are used beyond what is necessary to inspect their condition, characteristics and functioning, and as a result show signs of use, soiling, stains, odours, animal hair, damage or other loss of value that rules out or hinders their resale as new goods, we reserve the right to claim reasonable compensation for the loss in value in accordance with the statutory provisions (Section 357a BGB).
The amount of compensation depends on the loss in value incurred and may in particular include the necessary cleaning costs, classification as B-grade goods, or – if resale is no longer possible – the full value of the goods.
The condition of the returned goods is inspected and, where applicable, documented upon receipt.
Hygiene notice
As these are baby clothes, we ask that items be used for trying on only. For hygienic reasons, returns of worn or soiled items can no longer be sold as new goods and may therefore result in reasonable compensation for loss in value pursuant to Section 357a BGB.
§ 9) Shipping of pre-orders
One package, one journey, for the environment.
To avoid unnecessary shipping routes, we send your entire order in a single package once all pre-ordered items are available. Thank you for sharing this small but important contribution with us.
§ 10) Transport damage
Should any transport damage occur during shipping, this must be reported immediately to the delivery service and the seller must be informed. If the customer fails to do so, this has no effect whatsoever on their statutory or contractual warranty claims.
§ 11) Warranty, guarantee and custom-made goods
The statutory right of return applies to clothing, provided a defect is present and unless expressly agreed otherwise. Should a defect be found in an item of clothing, the buyer has 30 days from receipt of the goods to exercise their right of withdrawal.
Please note that only unworn, unwashed goods with the original label attached can be taken back.
The costs of a return are always borne by the buyer.
Shipping costs incurred will not be refunded.
§ 12) Alternative dispute resolution
The EU Commission provides a platform for online dispute resolution on the internet at the following link: https://ec.europa.eu/consumers/odr
This platform serves as a point of contact for the out-of-court settlement of disputes arising from online purchase or service contracts involving a consumer.
The seller is not obliged to participate in a dispute resolution procedure before a consumer arbitration board.
